NJ Governor Authorizes Superintendent of State Police to Commandeer Resources
On April 2, 2020, Governor Murphy signed an executive order (EO 113) authorizing the Superintendent of the State Police to commandeer personal services, real property, and personal property, including medical resources, to combat the COVID-19 health emergency. Any affected businesses and individuals will be compensated in accordance with New Jersey’s Disaster Control Act. This sweeping order will allow the State to, among other things, take personal protective equipment from businesses and distribute it to health care providers. The order will also allow the State to temporarily seize private buildings and property to use for the emergency response. A copy of EO 113 can be found here.
