Rachel E. Simon, counsel at Pashman Stein Walder Hayden P.C., was mentioned in Legal Newsline for representing the City of Newark with firm partner Raymond M. Brown in a lawsuit they filed against Hyundai Motor America, Inc., and Kia America, Inc. The lawsuit alleges that the automakers' knowing and intentional failure to install industry-standard, anti-theft technology in their vehicles led to an epidemic of car thefts in the City. Newark joins nineteen other cities nationwide, including New York, Milwaukee, and Seattle, in seeking to hold the automakers responsible for the public consequences of their security failures.

The Complaint states that Kia and Hyundai thefts increased more than 1000% between 2022 and 2023, requiring the Newark Police Division to dedicate nearly 20,000 hours in overtime auto-theft suppression, costing the City over $1 million in taxpayer dollars. Simon argues on behalf of the City of Newark that these vehicle thefts endanger citizens, leading to reckless driving, accidents, increased violence, and depletion of emergency resources.
