Pashman Stein Walder Hayden P.C. Achieves Appellate Division Win, Paving the Way for Redevelopment of Riverfront Property in Edgewater

Pashman Stein Walder Hayden P.C., together with co-counsel Greenberg Traurig, LLP, secured a win for client 615 River Road Partners, with New Jersey’s Appellate Division affirming the dismissal of a challenge brought by a nearby property owner in connection with the client’s proposed redevelopment of a riverfront property in Edgewater.

In 2017, Pashman Stein filed a lawsuit on behalf of 615 River Road Partners against the Borough of Edgewater, seeking damages and other relief for violations of federal civil rights laws in connection with Edgewater’s attempt to condemn the riverfront property after 615 River Road Partners remediated the property in preparation for development of a mixed-use, high-rise building, which included affordable housing, parks, and other benefits to the public. In 2019, the District of New Jersey denied Edgewater’s motion to dismiss the complaint; subsequently, the parties entered into a settlement agreement for the redevelopment of the property that permitted fresh consideration of the redevelopment on its merits, which, among other things, provides for substantial affordable housing, public green space, traffic improvements, and, as part of the settlement, transfer of land on which Edgewater plans to construct a new public school.  The settlement and ensuing redevelopment designation were challenged by a nearby property owner.  That challenge was dismissed in 2022 after trial, which decision was upheld by the Appellate Division on August 13, 2024.
